Terms of Service

1. Acceptance of Terms

By creating an account or using 321ZERO ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform.

321ZERO is a service being developed and operated from Jersey, Channel Islands.

2. Eligibility and Your Account

You must provide accurate information when registering and keep your account details reasonably current. You are responsible for activity under your account and for protecting your login credentials. Notify us promptly if you believe your account has been compromised.

Do not create accounts to evade applicable plan limits or use another person's account without permission.

3. Plans and Fair Use

Published plan descriptions may include limits on sites and users:

  • Free: 1 site and 1 user, manual entry, Scope 1–3 calculations, a basic dashboard, emissions history and download of your own records as CSV.
  • Insights (£75/month): 1 site and up to 3 users in total, including the owner, spreadsheet import, formatted Eco-Active exports and public carbon snapshots.
  • Business Assisted (£275/month): one organisation and 1 site, up to 5 users in total including the owner, plus the current Insights features. Support allowance: each support period is each successive three-month period beginning on the service activation date. Each support period includes one 45-minute scheduled session and up to 45 minutes of asynchronous reporting assistance, for checking data completeness and preparing reporting. Unused allowance does not roll over. Normal support for software faults is not deducted from this allowance. Work beyond the allowance is agreed before it begins, with no surprise charges. The customer remains responsible for supplying information, approving figures and submitting returns. Optional assisted onboarding (£495, up to 2 delivery hours against an agreed scope) and annual reporting assistance (£495, up to 3 delivery hours, based on one clean dataset supplied by the customer, including one draft review and one revision; required software access is additional; data cleaning, reconstruction and additional complexity are quoted separately) are one-off services quoted before they begin.
  • White Glove: a managed carbon-data and reporting service. Limits, services and pricing are agreed in writing for the relevant engagement; each proposal lists what is and is not included before you commit. White Glove does not automatically include independent verification or assurance, government approval, technical certification or unlimited consultancy; where those are required, a separately appointed qualified professional may be needed.

Spreadsheet imports and Eco-Active exports are currently available on Free at no charge. We will give reasonable notice before these tools move fully to paid plans. Your saved records and raw-data downloads always remain accessible.

Plan upgrades are arranged through a short conversation so support and access are set up correctly. Planned features, including year-on-year comparisons, multi-site management and advanced report templates, are clearly marked and not included today. The same calculation methods apply across plans.

Current features, pricing and limits are those presented at signup or agreed with you. Team access and publishing require an active company plan or arranged access. Pending invitations reserve seats. If access expires, shared access and public snapshots stop; the owner retains access to company emissions. Preview, demo and early-access features may change or be withdrawn.

You must not resell access, use the Platform as the backend of a competing service, interfere with its operation, attempt unauthorised access, or run automated activity that places an unreasonable load on the service.

If usage appears to fall outside reasonable fair use, we will normally contact you before restricting it, unless prompt action is reasonably needed for security, fraud prevention or service protection.

4. Data, Browser Storage and Privacy

Signed-in company profiles and emissions records are saved in Supabase, with access restricted to the owner and authorised team members. A browser working copy is also retained. Demo records and custom site or activity settings are stored locally. A failed cloud save may retain a local fallback; check any saving or synchronisation notice before clearing browser data.

Protect access to your device and retain exports you need. Supabase provides authentication and database services; Netlify hosts the platform and stores enquiries. See our Privacy Policy for processing, retention, deletion and rights information.

5. Carbon Calculations

Calculations use the emission factors identified by the Platform, which may include factors from DEFRA, Government of Jersey materials and local utility information. Factors, methodologies and source data can change over time.

321ZERO provides calculation and reporting tools, not professional environmental, accounting, legal or assurance advice. Results depend on the completeness and accuracy of the data you provide. Review calculations and generated reports before relying on or submitting them. Use an appropriately qualified professional where independent verification, audit or regulated advice is required.

6. Public Ticker and Published Content

Only the company owner can publish a reviewed annual carbon snapshot. The snapshot contains the company name, scope totals, reporting year, record count, month coverage and publication date. It excludes individual records, costs, notes and team contact details. These are company-reported figures, not independently verified results.

You must have permission to share these figures. Review their completeness and accuracy before publication. Adding, editing or deleting private records does not automatically update a published snapshot: publish an update when ready.

Turn off public sharing in the dashboard to withdraw the snapshot. Open embeds refresh periodically and normally clear within one minute. Copies or exports already made by other people cannot be recalled.

7. Exports, Social Copy and Submissions

Generated reports, spreadsheets, CSV files, emails and social media text are provided as drafting conveniences. You are responsible for checking their accuracy, suitability and recipients before using or publishing them.

The Platform may help prepare an Eco-Active return or open a draft email, but it does not submit a return to the Government of Jersey unless a future feature expressly says otherwise and asks for your authorisation. 321ZERO is independent of the Government of Jersey and the Eco-Active scheme.

8. Payments and Cancellation

Selecting a plan at signup records your preference; it does not take a payment or activate a paid subscription. Additional company features require arranged access; payment is arranged on activation live. Before taking a payment, we will present the applicable price and billing terms.

If recurring billing is introduced, the cancellation timing, renewal terms and any refund rights will be disclosed before purchase. Any statutory rights that cannot legally be excluded will continue to apply.

9. Service Availability and Changes

The Platform is provided on an available basis and no uptime service level agreement is offered under these standard terms. The service may be interrupted by maintenance, faults, security work or third-party provider outages.

We may change, suspend or discontinue features as the Platform develops. We will try to provide reasonable notice of material changes where practicable, particularly where they affect paid access or data export.

10. Disclaimer and Liability

We will provide the service with reasonable care and skill. We do not promise that the Platform will be uninterrupted, error-free, suitable for every reporting requirement, or that generated results will be accepted by a regulator, scheme or third party.

To the extent permitted by law, 321ZERO is not responsible for indirect or consequential loss, loss caused by inaccurate input data, or loss of locally stored data that you have not exported or backed up. Nothing in these terms excludes liability that cannot lawfully be excluded or limits your mandatory rights under applicable Jersey law.

11. Suspension and Termination

You may stop using the Platform at any time. We may suspend or terminate access where you materially breach these terms, misuse the service, create a security risk or use the Platform fraudulently or unlawfully.

Where reasonable, we will give notice and an opportunity to remedy a breach or export available data. Immediate restriction may be necessary for fraud, abuse, security incidents or legal compliance.

12. Changes to These Terms

We may update these terms as the Platform develops. The latest revision date appears at the top. If a material change affects an existing paid arrangement, we will provide reasonable notice where practicable. Continued use after updated terms take effect constitutes acceptance of those terms.

13. Governing Law

These terms are governed by the laws of Jersey. The Jersey courts will have jurisdiction, subject to any mandatory rights or jurisdiction rules that apply to you.
